In my case, one of my pics must have gotten used without my knowing or doing to promote a photo contest sponsored by my neighbourhood H-D dealership.
I am not even sure if I ever made this picture available for grabs in said social media, so when I discovered the ad I felt somewhat between miffed and flattered. Well, I guess the flattered part won. Besides, I really appreciate the excellent job their service department is doing, hence the publication permission will be herewith granted ex post, wherever this particular picture was snagged from.
Here is the original, taken last summer on my first solo trip doing the Lillooet loop, which I am planning to repeat this summer, hopefully with the spousal unit in tow.
PS: I have sent the H-D dealership an email...

ReplyDeleteI'd be a bit like you Sonja, a bit miffed and a bit flattered, tho I still think it would be nice to be asked before anyone publishes a picture like that, at least you would have had a heads up and could have told all your friends and relatives to look for it so you could brag!!
I would have been a nice gesture to have asked, and I would have granted it and bragged about it ;-)
DeleteI usually put a watermark on my photos but that doesn't mean someone can't take my photos because they can just crop the water mark.

My facebook account only exist because my motorcycle club organize their meeting over it. Otherwise I wouldn't be there.

ReplyDeleteUnfortunately I didn't know about that contest until last night when I was sourcing for farkles on their website. I didn't win anything.
DeleteThe problem with the internet is that a picture can be passed from one person to another easily. That leads to issues of ownership. When ever possible I try to to give credit to who ever took the photo, and I had a problem with an older blog I wrote where I credited person A....only to receive a note from person B stating it was their photo. I ended up taking the whole thing down just to avoid issues. Anyhow it's still an honor and a lovely picture. :)
ReplyDeleteThanks Robert. My pics are just point and shoot, and I don't claim it as artwork. As long as people ask and give me credit if they really want to use one of mines I am totally ok with it (depending on the content that they want to put it in)
DeleteI finally deactivated my FB account a few weeks ago (they don't allow cancellations...hhhmmm) as I was seeing my blog posts, that I did not authorize, appearing on the "timeline". That was the last straw in a series of disgruntlements with FB (timeline, data mining, etc.).
ReplyDeleteAlso, someone on Blogger has posted that another blogger is stealing articles from all of us and posting them as if they are his.
This bothers me but I have 4 blogs and no intention of quitting those. I'll take my chances, though I am thinking of adding a "copyright" blurb on each one.
I had mine deactivated until I joined a female riding club but usually I don't post much there. But things can easily taken from one of my other blogs as well and I would probably never know. I am thinking to put in a copyright thing as well, but as Chillertek said, if you crop it, it is gone, too.

I remember seeing something about a site that automatically searched for your material on the web? That's how they found out about the blogger who was just cutting and pasting and claiming it was original material. I wish I remembered the site name.

I wonder if someone pilfered the picture then the HD shop found it after and didn't know it belonged to you. Hmmmmm.
I don't think that they know about the blog. It might as well be as you say, and somebody else snagged it, so they weren't aware of the original source.
Deletethey owe you royalties, and so personally i would bitch. and as well, if not addressed, they may continue this behavior. it's too bad, all businesses have to do is ask for permission. i think most of the time permission would be granted. :( ugh... sorry... it is a gorgeous pic!
ReplyDeleteI will go and talk to the manager next time I visit to find out where they got the picture from. Maybe they are going to take the right steps from there... We'll see.
DeleteUnfortunately, if you read the terms of service with FB, the wording suggests that they own the copyright on any picture, text, whatever is posted and they can use it for anything they want. The assumption is that no one ever read through the click through agreement. I know a few lawyers that did and decided not to create an account. I have one that I use for external authentication as some sites seem to insist on it but have no friends and have never posted anything...

DeleteI'm with Ms. M. on this. I would think that any business is simply foolhardy to use a picture that they can't verify ownership of. It's one thing for bloggers to liberally cut and paste, but for a business? Ist verboten! So I would be inclined to go to the dealer with a copy of the original picture and simply ask how they intend to recognise the owner, i.e. you. Good luck.

ReplyDeleteI got a response back from the guy in charge of that particular marketing gig. My impression is that he isn't aware of the consequences. I wrote him another email briefly explaining the potential legal implications. I haven't heard back from him since. Maybe I should take it up with his manager...
